1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of pixkoz (the "Service"), operated by pixkoz ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Definitions

• "Service" — the pixkoz platform and all related products, features, and functionality, including Magic Spells, Virtual Try-On, AI Chatbots, and the credits wallet.
• "Credits" — the prepaid units used to pay for actions on the Service.
• "Creator" — a user who publishes spells or other content that other users can use.
• "Content" — any images, prompts, text, files, or other material uploaded, created, generated, or transmitted through the Service.
• "You" — the individual or entity using the Service.

3. The Service

pixkoz is an AI creative platform that lets you:

• Cast Magic Spells — apply creator-made AI transformations to your own photos.
• Try on outfits virtually — visualise garments on a person from uploaded images.
• Build and deploy AI Chatbots — trained on your own documents and links, and embeddable on your site.
• Manage one credits wallet — a single balance that works across every product.

Features rely on third-party AI providers and may change, be added, or be removed over time.

4. Accounts & Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Provide accurate information and keep it up to date.

5. Acceptable Use

You agree not to use the Service to:

• Violate any law or regulation, or infringe anyone's intellectual property or privacy rights.
• Upload images of a person without their consent, or content you do not have the rights to use.
• Create, generate, or distribute unlawful, harmful, hateful, sexually explicit involving minors, or non-consensual intimate content, or content that impersonates or deceives.
• Transmit malware, or attempt to gain unauthorised access to our systems or other accounts.
• Interfere with, disrupt, or place undue load on the Service.
• Resell, sublicense, or redistribute the Service without our written permission.
• Use automated means to access the Service beyond what a normal user would reasonably generate.

We may suspend or remove content and accounts that violate these Terms, and may report unlawful activity to the authorities.

7. Creators & Earnings

As a Creator you may publish spells that other users can cast. You are responsible for ensuring your spells and prompts are lawful, do not infringe others' rights, and comply with these Terms. When another user completes a paid cast of your spell, you earn the Creator share of the credits for that cast, at the revenue-share rate in effect at that time. Eligible earnings may be cashed out subject to our payout process, minimums, and verification. We may withhold or reverse earnings arising from fraud, abuse, chargebacks, or violations of these Terms.

8. Your Content & Intellectual Property

You retain ownership of the images and content you upload and, as between you and us, of the results you generate — subject to the terms of the underlying AI providers. You grant pixkoz a worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit your content solely to operate, provide, secure, and improve the Service (including sending it to AI providers to produce your results).

The Service itself — including its software, design, and branding — is owned by pixkoz and protected by intellectual-property laws. You may not copy, modify, reverse engineer, or create derivative works of the Service. A Creator's underlying spell prompts remain the Creator's and are not disclosed to the users who cast them.

9. AI-Generated Content

pixkoz uses artificial intelligence to generate results. AI output can be inaccurate, unexpected, or not what you intended, and results for the same input may vary. Results are provided for your use "as is," and you are responsible for how you use them, including ensuring you have the rights to any input images and that your use of the output is lawful. We do not warrant that any output is accurate, appropriate, or fit for a particular purpose.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, pixkoz will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

These Terms are governed by the applicable laws of the jurisdiction in which pixkoz operates, without regard to conflict-of-law principles. Any disputes arising from or relating to these Terms or the Service are subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

14. Changes to These Terms

We may modify these Terms from time to time. When changes are material, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
